现在生活水平提高之后，很多家庭都开始选购汽车了，随着二胎的开放，对车子要求也多了起来，在选购车子的时候都会优先选择SUV，一般SUV都是5座车居多，一般的家庭是足够使用的，但是人多的时候，SUV的座位就不够用了，经常有人发出疑问，在规定限载5人，那多出一个婴儿算超载吗？交警给出明确的解释！对此让我们一起来看看。
为了交通安全，交通法规关于“超载”有严重要求，并且没有对人员的身高、体重等进行限制，就算是襁褓中的婴儿也都要算上，在交通安全法里有规定，运营客车（不包含公交车）、校车以外的载客汽车超过规定人数但还未超过20%的予以200元的罚款并且扣三分，超过20%予以200元罚款并扣6分，行车途中，不乏出现大人抱着小孩一起出的事故，虽然不一定是因为超载造成，但一旦发生事故，那后果是不堪设想的。
并且搭乘的乘客都是以人为计量单位，不管是婴儿还是小孩都是个体，都是人，都应该受到尊重，受到公平对待，所以这种现象属于超载，交警查到后会依法处置，而且把小孩子也算作乘客之一也是为了孩子的人身安全考虑，另外如果遇到前车突然无故刹车导致追尾，按道理在举证完全的情况下，后车是不用承担责任的，但如果后车超载，在责任划分上就又是另一种说法了，因为超载会影响刹车性能，交警会根据事故的因果关系来做出责任认定。
所以，请各位车主务必重视起来，出行千万不要心存侥幸，忽略了超员的危险性，无论乘客坐在汽车里的哪个位置，都务必一定要系好安全带，建议儿童坐私家车最好使用安全座椅！儿童乘车时，除非是无法独立乘坐的婴儿，否则应坐在固定座椅上并使用安全带等防护设施。交警查处超员违法行为时，以实际乘坐人数确定是否超载及超载比例，实际乘坐人数包括驾驶人和已经可以独立乘坐的儿童，公路载客汽车在载客已满的情况下，可以加载不超过核载人数10%的免票儿童。也就是说，公路载客汽车以外的机动车，是严格执行不能超载规定的。
