借车又惹祸？违章206次，扣841分，累计罚款31550元！

生活中，借车出事的情况频频发生。借车自己心疼，不借车得罪朋友。这里小编给大家整理了以下一些情况，供大家参考“借还是不借”。

车主无赔偿责任的情况

一、借车人有合法驾驶资格：

《中华人民共和国侵权责任法》明确规定：借车给他人使用后出事故，造成的损失由保险公司和驾驶员承担，车主无过错，不承担赔偿责任。

车主无过错须满足一下3点：

1、借车人有驾照且未吊销和过期。

2、准驾记录与所驾车型相符。例如C2类的驾照就不能开C1类的车。

3、对方借车时无酒驾、毒驾等法律禁止行为。

二、因机动车使用人造成事故：

《中华人民共和国侵权责任法》规定：因租赁、借用等情形机动车所有人与使用人不是同一人时，发生交通事故后属于该机动车一方责任的，由保险公司在机动车强制保险责任限额范围内予以赔偿。不足部分，由机动车使用人承担赔偿责任。

三、借车人肇事后逃逸：

车主无过错，就无需承担赔偿责任。车辆借出后驾驶人肇事逃逸，由保险公司在限额范围内赔偿，不足部分由道路交通事故社会救助基金垫付。如果车主无法举证肇事人责任，则须承担相应的赔偿责任。

四、借车人无赔偿能力，车主须垫付：

如果事故造成的损失较大，导致肇事司机赔偿不了。法庭会判决车主垫付赔偿金，但垫付金额不会超过汽车自身价格。事后，车主可以向肇事司机或其家属追讨垫付的金额。

车主有赔偿责任的情况

机动车所有人对损害的发生有过错的，承担相应的赔偿责任。如：

1、借给喝了酒的人：

明知借车人喝了酒，或服用国家管制的精神药品或麻醉药品，或患有妨碍安全驾驶的疾病等依法不能驾驶机动车的，还将车出借。

2、出借故障车：

车主知道或应当知道机动车存在缺陷，且缺陷是造成事故发生的原因之一的。

3、借给无驾照者：

知道或者应当知道借车人无驾驶资格或未取得相应驾驶资格的。

注 意

如果你要借车给朋友请注意以下5点：

1、问清借车的时间和目的，方便作出判断

2、事先检查违章，避免事后扯皮；

3、告知相关证件位置，介绍车辆状况；

4、为保证双方利益，建议共同拟定一份借车协议，分清双方责任；

5、提供备用钥匙，降低风险。

如果你要借车请记得以下细节：

1、开车时请小心再小心；

2、车内物品不要乱动；

3、长时间使用时给车主报个平安；

4、如遇剐蹭，坦诚告知并负责维修；

5、归还前加满油、把车清理干净；

6、记下车牌号，方便查询违章并主动承担。
