河南车主买奔驰车出故障去维修发动机的中缸，没想到奔驰4S店竟从汽配市场购买了一个“三无”中缸进行更换，最后车主在行驶过程中遇到发动机“爆缸”，愤怒之下车主将奔驰4S店告上法院，并投诉至郑州市市场监督管理局。这到底是怎么回事呢？一起来看看！
近日，河南省郑州市的蔡先生爆料：他要为自己的奔驰车进行维权，这件事还要从3年前说起。2016年11月份，蔡老板花费43万元全款购买了一辆奔驰E200L轿车，而奔驰车在开了半年后出现故障了。
2017年7月份，天空突降大暴雨，蔡先生的车突然出毛病了，于是就决定被送往当初买车的那家4S店。蔡先生的奔驰车在保险公司安排下将车拖至郑州汇升奔驰销售有限公司（以下简称汇升奔驰）进行维修，很快检查结果出来了，对方称中缸坏了，缸体没办法再维修，只能换一个全新的发动机，而更换发动机却是个天文数字。面对21万余元的维修费用，保险公司当初拒绝了。
随后，有人介绍了另外一家授权的4S店，“保证使用原厂配件，保证质量”，随后，蔡老板的奔驰就交给了这家店。一直到2个多月后，有人通知蔡老板提车，本以为事情就这样结束了，蔡老板却怒火中烧。
蔡老板修好车后，开了大约1000公里，车子再次“罢工”了。奔驰故障灯突然亮起，可刚经过大修的车怎么会有问题呢？怀着各种疑问，蔡老板将车开往了那家维修店，可还没到4S店车就彻底瘫痪了，爆缸坏在半道上。
并且4S店很快给出了意见：“故障灯你还开，司机的责任”，意思就是他们不负责，一气之下，蔡老板将这家店告到了当地市场监督管理局。
经过郑州市市场监督管理局工作人员调查，发现蔡先生的这辆奔驰车，此前维修中被更换的发动机中缸，是一件“三无产品”，并且中缸上的发动机编号也是被私刻上去的。
随后，法院给出了如下判决：假一赔三，共计赔付17万多元。可蔡老板认为17万远远不够他的修理费用，第一次修车花费15万6,（保险公司出），第二次修车19万（自己出），加上租车费6万元，共计30多万。
法院认为，保险公司与汇升奔驰签订有《保险事故车辆维修合作协议书》，对维修必须使用原厂配件有专门约定，且该约定明确维修对象是保险公司承保客户车辆。而汇升奔驰在修车过程中未经原告同意使用非原厂配件，构成欺诈，应赔偿中缸费用的3倍。
对于该判决结果，蔡先生表示将提起上诉。他表示，该判决中赔偿的费用“远远不够自己修车的费用，更何况耽误了两年多时间，现在车连全国联保都享受不了了。”
